1. Scope of Application

These terms apply to all orders placed via our online shop by consumers and entrepreneurs.

  • Consumers: Any natural person acting for purposes outside their trade, business or profession.
  • Entrepreneurs: Any natural/legal person or partnership acting within their trade or profession.

Note for entrepreneurs: Your own conflicting or supplementary terms are not valid unless explicitly accepted by us.

2. Contractual Partner, Conclusion of Contract, Correction Options

  • Contract is concluded with CLS Dafa GmbH.
  • Product listings in our online shop represent binding offers.
  • You may add items to your cart without obligation and edit entries before final submission.
  • The contract is formed when you click the “Order” button.
  • You will receive an email confirmation immediately after submitting your order.

3. Contract Language & Storage

  • Contract language: German
  • We store the contract text and email you the order details and terms. For security reasons, the contract text is no longer accessible online.

4. Delivery Conditions

  • Shipping costs may apply in addition to product prices.
  • Detailed shipping terms can be found in the respective offer listings.

5. Prices & Payment Methods

5.1 Total Prices

All listed prices include applicable taxes and charges.

5.2 Shipping Costs

Shipping fees are not included unless stated otherwise and will appear separately at checkout.

5.3 Cross-Border Payments

For deliveries within the EU but payments made outside, you are responsible for transfer or exchange fees.

5.4 Payment Options

5.5 Payment Due

Unless otherwise noted, payment is due immediately upon order confirmation.

6. Right of Withdrawal

  • Consumers are entitled to a statutory right of withdrawal (see cancellation policy).
  • Entrepreneurs are not granted a voluntary right of withdrawal.

7. Reservation of Title

  • Goods remain our property until full payment is received.
  • Entrepreneurs: All goods remain our property until all obligations from the business relationship are met.
  1. You may resell the goods; claims from resale are assigned to us in advance.
  2. We may collect claims if your payment obligations are not fulfilled.

8. Transport Damages

For Consumers:

  • Please report obvious transport damage to the carrier immediately and contact us.

For Entrepreneurs:

  • Risk passes to you upon delivery to the carrier.

9. Warranty and Guarantees

9.1 Liability for Defects

  • Statutory warranty rights apply unless otherwise stated.
  • Limitations do not apply in cases of:
  1. Injury to life, body, or health
  2. Intentional/gross negligence
  3. Fraud or breach of cardinal obligations
  4. Product Liability Act applicability

Entrepreneurs:

  • Only written agreements and manufacturer specifications are valid.
  • Warranty period: 1 year from risk transfer for new goods.
  • Merchants: Obligated to inspect goods and report defects (HGB §377).

10. Liability

We are fully liable for:

  • Injury to life, body, or health
  • Intentional or gross negligence
  • Guarantee fulfillment
  • Product Liability Act cases

In case of slight negligence:

  • Liability is limited to foreseeable, contract-typical damage related to cardinal obligations.

11. Dispute Resolution

  • We are willing to participate in out-of-court settlements with consumer arbitration boards.

12. Final Provisions

  • For entrepreneurs, German law applies (excluding UN Sales Law – CISG).
  • If you are a merchant or legal public entity, jurisdiction lies with our registered office.
